Response to Sen Durbin's Radio Address, Dec 8, 2007

Senator Durbin:

I listened to your Democrat Radio Address more than once so that I could respond to it.

First: The Political Party is incorrectly written and spoken by media and even Congress people. When speaking of the Party, it’s Democrat. We all are “democratic” whether we adhere to the Democrat Party, the Republican Party, the Libertarian Party, the Constitutional Party, etc. Please try to educate Congress in the correct use of the term “Democrat” and “democratic.” As a listener and reader every time the incorrect term “Democratic” is used when the person means Democrat Party, I cringe. I would appreciate your cooperation so that I no longer have to cringe. Thank you.

Second: You call the Republicans to task stating they are making a “no can do” Congress when you and I know that the reason is because nearly every bill includes Democrat and even Republican PORK or amendments attached to bills which are not even related by topic to the intent of the original bill. When are you Congress people going to stop attaching unrelated PORK or unrelated and unrealistic amendments to bills and give the U.S. public bills which are straight forward, honest, and have no room for interpretation? If you’ve followed any particular bill from inception to implementation by the various States, you will find that by the time the States decipher it, the original intent is usually so redefined that you in Congress would not recognize it as the original bill. If you disbelieve it, get a staff member to do some research.

Third: The mortgage situation doesn’t need any Congressional money thrown at it to try to “fix” it. Housing equity will eventually rise to its previous level and then some. It always does. There would not be this temporary “meltdown,” as you call it, if Congress and the Federal Reserve would quit trying to influence interest rates to the benefit of rich investors, many of them from overseas (my best guess). The rich get richer and the poor get Congressional monetary assistance which in turn means that the poor do not have to accept responsibility for their financial investments in a house. And why do people purchase housing they can’t afford? Because sales people want their commission? Because people listen to and believe that they “deserve” the “good life” whether they can afford it or not? Why do banks fill people’s mailboxes with offers of charge cards? Why does the “mail” encourage people to overspend? The issue which needs to be addressed is a person’s innate greed for more and lust for bigger-better-newer. And this area is not Congresses responsibility, no matter how many voters tell you it is. Each of us is responsible for his/her own actions and the problems arising from those actions. True Congress and the Federal Reserve is partially responsible for initiating the current financial mini-crisis, but the people who purchased houses they could not afford to keep and to keep up are also responsible. I will grant you that the construction industry has built too many “speculation” houses. But this again is not Congresses problem. What happened to “supply and demand” economics? What happened to personal responsibility?

Fourth: The U.S. already has good “toy safety laws” on the books. The U.S. Consumer Product Safety Commission, like most areas of enforcement in this Country, is under funded and under staffed. Yes, a bipartisan (truly bipartisan with no PORK and no added amendments) bill to increase surveillance at the point of entrance into the U.S. and to penalize those overseas manufacturers who fail to follow U.S. guidelines for toys exported to the U.S. is needed. So to are Federal funds for more ‘hands on’ inspectors, giving them state-of-the-art laboratories in which to test toys, which would greatly enhance the safety of toys. Another way to look at this issue is to make parents ultimately responsible for their choice of toys for their child and eliminating any lawsuits by parents against toy manufacturers. Instead, a Federal law would cause an overseas contractor to lose existing contracts to produce toys for a specified time limit. And you know what just might happen? Parents would be influenced to “buy American” which is good for the U.S. economy.

Fifth: I think it humorous that a Democrat would quote Lincoln. But then, it was Lincoln’s Congress which placed a tariff on goods manufactured in the South for sale in markets in the North. And Congress did not rescind this burden placed on the South until 1962. After World War II, did Congress treat Germany and Japan the same way it treated the South after the “Civil War?” Of course not. Talk about reparations for past sins, the North owes the South for what Congress did to penalize and subjugate us for so many years. When is Congress going to (ever) address this issue? Before any Federal Tax money is given to the heirs of slaves (and there were slaves in the North, too), Congress owes the South. When will we (ever) receive our due for the cruel and unusual punishment the North placed on the South? Lincoln was no “hero” you want him to be as far as his real motives and treatment of the Southern States. As for General McClelland, at least he had war ethics and a conscience.

Sixth: A Democrat led Congress boasts of increasing minimum wages. Fine, except that now the Mom and Pop stores along with some smaller franchise stores cannot hire the help they need and the manager or manager/owner has to work longer hours to keep the store open. Some Congress person failed to look at the bigger picture and (here I’d like to have an amendment) allow stores to hire teens to their 21st birthday at a lower than minimum wage rate. It might also keep a few tens of thousands of children in school longer so that they could start working with at least the higher minimum wage.

Seventh: If voters voted for change, why didn’t they get it? Rep. Nancy Pelosi has held bills in committee and refused to allow them to get to the floor of the House. This is change? Sen. Harry Reid (among other Democrats) has maliciously spoken against a sitting President and the Iraq War and made other statements, along with many Democrat Congress people, which are detrimental to the sovereignty of the United States. This is not the change voted for. Trust me on this.

Eighth: You claim you passed a tough ethics law but you and Congress have refused to examine the many cases against Hillary Rodham Clinton in an effort, I can only guess, to remain the majority Party in Congress. What kind of ethics is that? Why doesn’t the Congressional Ethics Committee take a very close look at these websites:

What are you afraid of if you state the Democrats are more “ethical” than the Republicans? Prove it. Scrutinize your own Party before attempting to examine the other Party.

Ninth: Democrats are supporting health Insurance for an “estimated” 10 million children. That number was off by about 75% in Georgia. Where do you get your numbers? And, dare I say, you’re going about medical coverage in a very expensive way. Let me explain that I have 25 year’s experience in the field of Medicaid and S-CHIP casework. I’d say I’m an expert. And here’s what I believe would be a much better S-CHIP idea. Ready?
A- End all Medicaid and S-CHIP for non-citizens and set up a totally separate category of health insurance for children and pregnant women who are here illegally to cover them and also to bill their home Country. Every one coming in for medical aid must produce birth verification from their home Country so that that Country can be billed. Since the Country will probably refuse, aid to that Country will be reduced by the amount of money spent on medical coverage for their citizens.
B- Keep the maximum for S-CHIP eligibility at 235% or less of the Federal Poverty Level.
C- Create another category which covers only Dental and/or Pharmacy and/or Vision coverage for families above 235% Federal Poverty Level up to 285% Federal Poverty Level. This would encourage families to retain private health insurance either through employer or privately held.
D- Create Seven Classes of S-CHIP, all of which are more like private health insurance instead of Medicaid look-alikes. If S-CHIP were more like private insurance, more households would not drop their insurance for S-CHIP.
E- Give States a “range” of premium payments consistent with private insurance, but slightly less than private insurance for their State and locality. This would also encourage families to retain their private insurance.
F- Include a small co-pay at doctor, hospital, pharmacy, dentist, and ophthalmologist or optometrist . This would be similar to most private insurance policies and again increase the likelihood that families would retain private insurance through their employer rather than drop the insurance on their children.
G- Those Seven Classes of S-CHIP would be 1) Medical, Pharmacy Dentist and Vision; 2) Pharmacy; Dentist and Vision; 3) Dentist and Vision; 4) Pharmacy and Vision; 5) Dentist only; 6) Pharmacy only; 7) Vision only. Parts 2 through 7 would be available not only for Families between Medicaid FPL and 235% FPL but also for Families between 235% and 285% Federal Poverty Level for household size.
H- Vision would include eye exams, corrective surgery for certain physical deformities of the eye not covered under the health insurance policy and 50% to 75% discount on eye wear for glasses or contacts.

Tenth: You state that the public is tired of the “infighting” in Congress. May I remind you once again, Rep. Nancy Pelosi is a divisive factor in the House and Sen. Harry Reid is a divisive factor in the Senate. And both of these belong to the Democrat Party.

Eleventh: Energy and Global Warming. First of all, Congress is responsible for both. Congress has neglected to increase emission limits and raise gas mileage to what I’d call “respectable” levels. I’m still driving my 1995 Ford Escort, 5 speed stick shift, that gets 38 to 40 miles per gallon. The catalytic converter still works and I still have the original muffler system and engine. And did I mention I get nearly 40 miles per gallon! Congress is in love with “Big Oil” as you are well aware and if you doubt, look at any Congressional list of contributors. J Congress has the power to buck the system and demand that cars be made now with higher gas mileage and with lower emissions limits. There is no reason to give the automobile manufacturers so much time to make changes. And if they can’t produce . . . then the problem is theirs and Congress does not need to go ‘bailing out’ any more manufacturers of anything. Demand and Supply. If Congress Demands it, auto manufacturers will Supply it. In the past, there have been inventors who have devised non gasoline using engines. Where are these inventions for alternative fuels? Who has them and why are they now? The Public believes that the auto manufacturers and oil companies paid off the inventors and trashed the invention just to keep the world and especially the U.S. subservient to Big Oil.

I personally do not believe in Global Warming any more than I believe in evolution of the species. I’m 63 and when I was in school we were terrified of the coming Ice Age. It never appeared, either. Global Warming is a hoax, sir. There’s not enough scientific (real science) evidence to prove it exists. There is only the same speculation used to create the fear of an Ice Age. If a person looks at the solar system as a part of a whole universe, then one sees that there are solar systems being created and dying all around us. Maybe they have a planet similar to the earth with people living on it. We look up in the night sky with our telescopes or the Hubble Space Telescope and take photos of a dying solar system or of an explosion creating another solar system thousands or millions of light years away. Did anyone think that our solar system is doomed to the same fate at some time in its existence? If our solar system was created as those we see millions of miles away, then our solar system will incur the same fate. And whether we see it in our lifetimes or not, we must accept as fact that this solar system will one day cease to exist.

Twelfth: Democrats call the War in Iraq a Civil War. Well, they called that war we had in the U.S. a Civil War, too. Only, we in the South call it, (present tense) the War of Northern Aggression. I’ve already mentioned this in the Fifth section above. Re-read the part about how the North kept its foot on the neck of the South until 1962 when the tariff against the South was rescinded. This is the very reason the South is proud of our heritage, our various flags, and our States Rights politics. Then you paraphrase the Lincoln phrase and state “what’s the use of having power if you can’t use it?” You know, Senator, that many of us in the U.S. wonder the same thing as it pertains to the War. Why didn’t we just A or H bomb Iraq and Afghanistan as we did Germany and Japan in World War II and once they surrendered go back in to help them rebuild? Why? Because the U.S. is afraid of the U.N.’s opinion? Or because we no longer have the “stomach” for victory by bombing? Initially, a couple of A or H bombs and this War would have ended as al qaeda and the taliban threw down their arms and gave up. And if they refused, toss in a few more each time we offer them the opportunity to surrender until they do. End of War.

Thirteenth: Lucky Thirteen. The U.S. Government has gotten too large for anyone or group to oversee and much too large for any group or person to try to micromanage. The Democrats fighting against the Republicans, while a time honored tradition, is a bit much in the 21st Century. Both sides and a few non-major Party affiliates, need to mediate and make decisions about running the Federal Government in a more precise and less obtrusive way. End Big Government – this won’t happen only because you all are Democrats and you are traditionally for Big Brother Government and micromanaging both States and U.S. citizens. Build the Fence – this won’t happen because some how you Democrats have it in your head that “some day some way” the illegal aliens among us are going to vote Democrat. It’s a false assumption, sir, check your history, immigrants have traditionally voted Republican. Free Ramos and Compean – you just might pass one of those specialized bills and do this, even as you investigate D.A. Johnny Sutton for abuse of power and collusion with a drug smuggler (who is related to a different Border Agent) on his second huge drug run into the U.S. Stop the NAFTA highway – would you confront your financial sponsors to accomplish this? U.S. roadways are not built for oversize, overweight trucks. If you really investigate the bridge collapse in Minneapolis can be directly linked to too many overweight NAFTA trucks driving over it. Probably most of the other InterState and Major Highway bridge collapses can be linked to overweight NAFTA trucks running from Mexico to Canada. And just WHY are Border Guards refused authority to inspect these trucks? Who’s responsible for that? One or some of those trucks may be filled with explosives. No one will know if no one has authority to thoroughly inspect the truck, driver, and destination. So why not just abandon the North American Union and the NAFTA Highway?

It’s been said that there is no way to deport the 21 Million Illegal Aliens in the Country. Everyone wants to excuse their breaking of U.S. law in order to find a “better life” for themselves and their children. Well, what about what their being in the U.S. does to us Citizens? The first mention of immigration is in the original Constitution.
Section 8. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;
To borrow Money on the credit of the United States;
To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
And also Article IV, Section 4 states: "The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."
Now let’s look at the 14th Amendment:
Article One
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. Crucial word here: either born or naturalized in the U.S. are “subject to the jurisdiction there of” are citizens. This says nothing about illegal aliens.
I think this is clear and concise language that defines who is and who is not a Citizen of the U.S. Congress has failed to protect U.S. citizens against the invasion from Mexico and other Nations, much to our detriment. We are not a “nation of immigrants” we are a Nation of Legal/Naturalized Immigrants. Make no mistake about it.
The finances that Congress needs to implement the S-CHIP are available if and only if the Federal Government mandates that all illegal aliens be returned to their home Nation. The money saved is in the billions. Verification is here: http://tinyurl.com/2rsvfy and the total yearly is $338.3 BILLION dollars. Billion. Verified. Every year that Congress fails to authorize the States to send Illegal Aliens back to their Country of origin, we, you and I and the rest of the U.S. loses $338,300,000.000. (Three hundred, Thirty-eight Billion, Three hundred Million, dollars.)
Either Congress is going to follow the Constitution and the Bill of Rights or it is going to ignore it and allow the Courts to legislate by judicial decision. Both not following what you swore to uphold and by abdicating your authority as Congress to allow various appointed and elected judges, including the Supreme Court, to legislate by judicial decision is neither democratic nor “what we voted for when we gave Democrats the majority in Congress.

Please take this letter to the Democrats in Congress (both houses) so that they can use this as a catalyst for positive change.

If you wish to know my political Party, I live in Georgia and we do not have to declare. If I did, I would declare Democrat as I am a “Dixie-crat” and one who remembers what Southern Democrats originally stood for. This does not assure that I would vote for a Democrat for President, but certainly for Sole Commissioner of my County Government. The Democrat Party of today is not the same as it was in my Grandfather's day. The South has stayed the same, the Democrat Party has changed.

Re-reading this after posting and emailing to Sen. Durbin, I see one typo and a couple missed punctuation marks.

But, all in all, I'm proud of my letter and I hope the Democrats in Congress get a clue.

Today, Dec12, I emailed a part of this letter to Speaker of the House, Nancy Pelosi.

It would make me so happy to hear that the House is revising their S-CHIP bill using my suggestions.

They're not too bright if they don't. By ridding the USofA of ILLEGAL aliens the S-CHIP medical coverage would be paid for by the money the USofA is no longer spending on ILLEGALS.

It's a Win-Win for the Sovereign USofA. Woooooo Woooooooo.
